Patrick's practice focuses on commercial litigation. Mr. Power's has extensive experience with complex business disputes involving intellectual property claims and shareholder oppression claims. In addition, Mr. Powers handles matters related to commercial debt and judgment collection, as well as construction defects, and personal injury matters.

Representative Experience

  • Represented shareholder in derivative claims against company involving allegations of shareholder oppression and self-dealing by officers of the company.  Representation included appointment of a receiver for the company and substantial litigation involving appropriate use of corporate assets, wasting of corporate opportunities, and improper shareholder and officer interference with corporate functions. Obtained favorable confidential settlement for client.
  • Represented companies, board of directors, and special committees in federal and state shareholder derivative and securities class-action lawsuits in both federal and state courts throughout Texas.  Representation in these matters has included indepth analysis and motion practice related to numerous motions to dismiss, substantial federal and state court briefing related to the Private Securities Litigation Reform Act of 1995, the Federal Securities Act of 1933, the Federal Securities Exchange Act of 1934, Securities Litigation Uniform Standard Act of 1998, interaction of Generally Accepted Accounting Principals, and application of other related state and federal statutes and acts.
  • Represented company in claims involving allegations of former officer and shareholder self- dealing, fraud, and breach of fiduciary duty.
